Scope and Contents
This is one of the books sold by David Alberts, LA book distributor, who was sentenced and fined for distributing "obscene and indecent" books such as "Sword of Desire," "She Made it Pay" etc. On appeal, there was a challenge to the constitutionality (First Amendment) rights but the conviction was upheld. Judge Brennan's formula for determining obscenity in the court's decision: 1) whether to the average person, 2) applying contemporary community standards, 3) the dominant theme of the material taken as a whole, 4) appeals to prurient interest.One of the more "obscene" passages follows: "His lips continued to stray over her flesh, her breath began to pant as the caresses grew more and more violent, progressing to the inevitable culmination. Her body jerked and strained. She cried out.'Oh darling, wait,' she gasped.An instant late they were locked in the most intimate of embraces, taking the full delight eah had to offer till they were left breathless and exhausted, and utterly content." -- Source of annotation: Marvin or Ruth Sackner.
